Resolved Question: Real estate Legal advice?
I agreed on a purchase price for a home for $500,000.00. I had a home for sale for the same price. I was wanting to wait to move into the new home after I sold my house. The owner was adamant I moved into the new home in April 1, 2008. We agreed on a price of $10,000.00 a month which I started paying in December of 2007, and have every month since. So I have paid $100,000.00. I went to his lawyers office which is in the same office as my lawyer. I asked my lawyer if it was ok to sign the Buy Sell agreement. He said it was a basic agreement. I knew I had to get financing by 12/15/08, or I would lose my money paid toward the purchase of the new house minus some Interest. The seller moved out of his house and left everything but their personal photos. The seller is regarded as a multimillionaire. I thought it odd he and his wife would move out and leave everything and move into a 14′x60′ mobil home! The agreement listed in the Buy Sell agreement the purchase price of the furniture for $20,000.00. He was insistent we move into his home on April 1, 2008. We did. A few months later the sheriffs office started attempting to deliver papers to the Seller. They left a set of papers with my wife for us to deliver to the Seller. I couldn’t help but read this suit. It was for the sum of almost $500,000.00 for a personal guarantee they made on a loan with a major US bank. I called my lawyer, he told me to return the papers to the sherriffs office. The next day, the sherrifs office came back to my home to drop off more papers. I returned the papers to the sherrif. The officer replied they had several more to serve to the Sellor and his wife. I hired a lawyer to investigate this situation. It was found Sellor was being sued for about $1,000,000.00. The house I am paying $10,000.00 a month on also had up to a $50,000,000.00 attachment for a real estate deal he was doing on condo construction. He denied he was being served papers. He said they were someone elses. I saw the paper. They were his!
Since, Sellors sister told me Sellors condos have a huge note on them, and the loan has been called. Sellors sister was concerned because her father built a new home and the same Sellor of my home, still owns the land fathers house is built on. Sister went to court house and said all of the property my new house, and her fathers house is on is tied up with the called note. I also found out he has a Line of Credit of $350,000.00 tied up in my home also. Sister found out Sellor has been taking $10,000.00 out of fathers account, as he has POA.
Sellor has started building a new home, but construction has stopped with bricks 4′ high. So I knew something was wrong with his finances.
He has been urging, even calling banks and setting up appointments for me to go and try to get financing on the home Sellor owns. I cant get financing on this home, because I havn’t been able to sell my house.
I am in the process of moving out, as Sellor has put everything he has up for sale. Sellor called me and told me I can move out, but this house is mine. I would have to keep making the $10,000.00 payments however until I sell Sellors house. I am out $100,000.00.
My lawyer and I met today, and he said the Buy Sell contract I signed didn’t have the usual terms in it to give me an out if I couldn’t get financing. The lawyer didn’t see this and didn’t advise me it needed to be in the contract before I signed it. Sellor is saying he will sue me for Specific Performance.
I have moved out the furniture from Sellors house, as the 1st two payments went to purchase of the furniture.
I also had a banker who was wanting to finance Sellor’s house for me, but it was found the 20′ of lake front was retained by Sellor. My banker informed me he couldn’t finance the property because the property had to go to the lakes edge.Seller told me I had a nice boat landing on the water. He didn’t say I could use it, that it was his!
What are my options if any except pay for the Sellors house? My lawyer told me I can’t list the home because I don’t own it.
Do I have any other options? Any Recommendations?

Resolved Question: Public association lying about my property to prevent sale? What would you do?
I am the owner/developer of a small development on a lake in Minnesota. We have a number of lots on a large lake. There is a lake association that has received some public money as well as grants. I learned that an elected member of the assoc. has spoken to at least two potential buyers stating the water in front of my lots is polluted. These are lies. I believe two individuals that were interested, contacted this individual with with questions about the lake and was told to stay away from my property. She has admitted to speaking to more than one person, but would not say what was said.

My questions: Do I have right to access the assoc’s correspondence to find out if these lies were indeed made by an elected member of this association? I suspect the correspondence was via email.

What expectations/requirements do they have in terms of saving such correspondence? Would I be able to access this without an attorney or do I need an attorney to request this information?
The individual with the association fought the development from the start because she feels it’s being overdeveloped. It is just under 5,000 acres, so by no means a small lake.
$200K x 18 lots so yes, very valuable. I know an attorney will see $$$ and want to take the case based on seeing $$ regardless of how good of case they think it is. Plus I have 5 that have yet to be plotted out. I think they’ve cost me at least two sales as two people who were very interested just vanished and purchased elsewhere. One had inquired about the lake and was going to talk to the lake association.

Your home inspector will inspect the electrical components of a home you are planning to buy. Many people wonder what the inspector will be looking at. Here is what you can expect from the electrical part of the home inspection.

1. Panel Box – The home inspector will examine the panel box for visible signs of defects, verify if the panel box uses fuses or breakers, locate the main disconnect, and verify the ampage for the panel box.

2. Wiring – The inspector will identify the type of branch wiring utilized in the home to take electricity to the light fixtures, switches, and outlets. All visible defects, like frayed, grounding or double taps, should be described in the home inspection report.

3. Type of Service – The home inspector will identify if the home has overhead or underground service providing power to the panel box and report any defects found.

4. Grounding Cable – The home inspector will locate and determine the type of grounding cable used for the home. In some cases, particularly underground service, the grounding wire may be inside conduit and not visible.

5. Fixtures, Switches and Outlets – The home inspector will test a selective number of accessible outlets in the home to verify they are grounded properly. The home inspector will operate the light switches to verify light fixtures are working properly. Any light fixture that doesn’t respond to the operation of the light switch will be noted in the home inspection report.

6. Ground Fault Circuit Interrupter (GFCI) – The home inspector will determine if GFCI breakers and outlets have been installed and what locations are protected by Ground Fault Circuit Interrupters. The home inspector will also test these outlets to verify they are functioning properly.

7. Smoke Detectors – The home inspector will check to see if smoke detectors are installed in the home.

The home inspection is designed to give you a general idea of condition the home is in. As with everything, findings are dependent on what is going on at the time of inspection and has some limitations. For safety reasons the following limitations generally will apply:

1. Insert testing instruments or tools any main or auxiliary electrical panels.

2. Engage an electrical system or branch circuits that are not on at the time of inspection.

3. Do not move appliances or furniture to get to electrical outlets or panels.

4. Inspect components or equipment that is not easily accessible.

5. Tear apart equipment for any reason.

6. Not required to test all receptacles and fixtures.

7. Remove electrical cover plates on outlets and switches.

LEED Green Associate: An Introduction

There is a growing green industry throughout the world. Individuals working in green technologies and industries can be found in solar energy, building design, hydro energy, and many other parts of new construction and retro-fitting of older buildings. When a building or alternative energy source is designed and created using green technology, it is inspected by a LEED Green Associate prior to it receiving the LEED certification.

When the Leadership Energy and Environmental Design (LEED) was created it quickly became a global entity. Throughout the world, governments have taken the need to design and build building that are energy efficient and environmentally sound. When the LEED was formed, a series of ratings were created that are used as the calculators for the benefits and incentives that are received by builders and companies whose buildings become LEED certified.

There are many courses available to prepare a person for the LEED Associate examination. There are also courses provided to certified associates who much re-certify on a regular basis.

When a building or residence has been inspected, the Associate completes a report that include the LEED rating. This report addresses each of the energy and environmental factors that are listed on the certification list. The report is then submitted to the US Green Building Council and the building is provided a rating certification number that is used to calculate the full benefit they will receive.

There are many different types of green jobs that allow a person to meet the eligibility requirements for the LEED Associate certification examination. Courses are provided to prepare for the lengthy examination and an person will find many resources available that can provide the necessary education and training to become an effective Associate.

With more contractors adhering to green technology, there is a greater demand for certified associates. This has resulted in more courses and training being made available for individuals interested in entering the field of green technology. As more incentives are provided by governments, there will be a greater need for inspectors of properties.

—-He was a patient man. If I were the one dealing with those agents, every day for three months, for hours at a time, I would have lost my temper long ago.
—-But he spoke softly to them, and with much more civility than any of them deserved. He waited for agent Reeves to finish his lectures and senseless rants, not once raising his voice to any of them, and he stood with his monstrous arms folded humbly across his chest.
—-It was clear that the man called Alexander wasn’t able or even willing to help any of these men, and I wondered why he didn’t use his size to scare them off. I’d seen him up close only once, when I’d foolishly fallen from my tree and cried out in pain. He emerged from his house when he heard me, and strolled clumsily toward the bushes where I hid from him. He flashed a bright light into the leaves, and I curled into a tight ball, holding my breath until he was gone. It was too dark, or maybe it was just the fact that he was still half-asleep, either way, he didn’t see me.
—-But I saw him; a monstrous, at least six foot five figure towering over the bushes. I could only make guesses at his weight, but by the way the earth shook when he stepped near me, I was sure it was well over two hundred pounds. I didn’t want to think about how strong he was. I made it a point to only go near his house when it was absolutely necessary, and undoubtedly safe.
—-Had I been as tall, I would scarcely let a short, fragile-looking old man like agent Reeves order me around. In my time, such behavior was virtually unheard of, in the general population, at least. Unless you are a Ministry official, it is punishable by ten years in the camps for even stepping into someone’s home without invitation. I didn’t know much about human behavior in 2011, but even without the strict regulations, it seemed stupid to be so reckless. Such hostility toward a man who could easily kill you with one hand if he desired, well, to me that was just suicidal.
—-From my tree, I could hear the men arguing as they walked side by side along the fence by the lake.
—-“I was told I’d have my grounds back by noon,” the man called Alexander said with his booming voice. “It’s already four-thirty, and I have work to do out here.”
—-“I understand that,” agent Reeves replied flatly. “But we also have a great deal of work to finish.”
—-“What kind of work?”
—-“Just a few last-minute details.” His voice was utterly uninterested. “Not that it’s any of your business.”
—-Alexander turned in his steps so he was standing in front of agent Reeves. “I’ve been nothing but co-operative since you started this investigation,” he said, “but this is getting ridiculous.”
—-Reeves chuckled. “You’ve been waiting to get your forest back for over three months. What’s another three hours?”
—-“That’s not the point,” Alexander challenged. “What the hell was the use of all my co-operation if you never intended to keep your end of the bargain?”
—-“You’re not going to cry, are you?”
—-There was a pause before Alexander spoke again. “This is my property, and I want you off it.” Although he wasn’t speaking to me, the change in his tone of voice made me nervous.
—-“I really don’t like your tone, Mr. Swain,” agent Reeves said. “Anyway you should be thanking me. You’re lucky we let you stay here at all.”
—-Agent Reeves took two steps toward Alexander and leaned in closer to him. He was foolishly unafraid when he spoke to the giant.
—-“Look,” he continued, “I like you. You seem like a nice guy, and you’re right, you have been very co-operative, but so have we. You might even say I’ve been very lenient.”
—-“Be straight with me, Reeves.”
—-“Just because we found no traces of the radiation affecting you, that doesn’t mean we can’t take you in for further testing. Who knows what they might find in a lab.”
—-Alexander was silent.
—-“Hm. That’s what I thought. The fact is, Mr. Swain, this is a federal matter. If the bureau were to think that an investigation of such importance had been hindered by your impatience, I can’t really say what actions they might take.” Even from up high, I could see the agent’s mock smile. “Now if you’ll excuse me, I have work to do.”
—-Agent Reeves walked slowly away, shouting out orders to the other agents who were busying themselves with their last-minute details. I watched as Alexander balled his hands into angry fists. He stood there a moment with his jaw clenched tightly before he stomped toward his truck.

The full dark grey clouds spread low all over the properties of Saint Caucus; They hung over like they had been building since late last night. I slowly tightened my jaw and blinked my eyes, and raised my large head up above my sagging body and long legs. I squinted my eyes against the still, cool brightness of the early morning, and drew a deep breath in. My long, gaze started at the chain link lot around me, it stands as a reminder that this is my home, most dogs would never allow this, but my lot and house is a peaceful, wonderful place, I have a view of everything that stirs around me, and a reason to stay out of trouble. my owners know I can push open the gate with my long nose, so a red, was out, heavily chewed dog leash hooks there, latching the door. I stared past the holes in the fence to the yard, I watched a scuffed, black mouse scoot quickly across my favorite lone converse sneaker of Amber Lynn’s., which has also been saturated in rain, and pushes down into the grainy, wet, dirt. My eyes followed across the scattered, bumpy, dirt road seeing Ruby, the four year old horse that Amber Lynn got when she was only eleven, on the other side. Her small corral was at the base of a hill that forms right in front of Lake Allison, it is scatted with hay belles and one small jump, that she won in a county fair. She looked handsome against the dark nature scenery. Her white- based ,icy blue eye looks misplaced against her slim black features and body. Of course, I’m not one to judge, my whole person looks out of place. I am a pit bull/ beagle mix, which a lot of times turns people away. I stand at a medium-short height, and have a medium build, I have loose skin, which Dangles at my neck, leaving my neck thicker than my head. I also have a long face, solidly colored caramel eyes, and I have the legs of a heavy set deer. Brown and black dominate my face, with a white stripe from my nose to my forehead, my back is heavily spotted in black, and clouded with large black splotches on top of a white base.
I arose to my feet on top of my quilt that is laid out on the ground, right before southern gospel music poured from the wall of the house that I am right in front of, signaling Amber Lynn’s clock radio alarm, which meant it was six o’ clock a.m., soon she would be leaving for school. Amber Lynn’s window blinds rise and she peers outside, her breather fogs the cold glass. Her shoulder length hair that is usually strait, is wavy and messy, her face is drowsy, and she is wearing a light tan tank top and grey pajama bottoms. She looks to my lot and smiles. Her front teeth are large and flat, and beside them smaller ones make a nice length in the apples of her cheeks, average pointy ones finish her smile next. I wagged my tail rapidly and searched for my voice. I let out a part broken howl, that was my specialty I usually did at night or when I am following a car. I woke up Dude, the rottweiler/ lab mix that shares my owners. I heard him sneeze in the section behind the house that was his, his lot was made of wood, while mine had chain link, that alone was about the only difference between our lots. Both of our dog houses had been personalized by Amber Lynn, with a brochure from our vet, Ms. Parker, pictures of Ruby from her shows, magazine clippings, the Lord’s Prayer, a school paper, and other things that catches her eye as something we would want, She even left a big, red lipstick kiss stain on our wall. I have a grey ceramic bowl for food, I also have a large, yellow bucket for water that, before I arrived was used for woodworking, which Darrin and Joe (Amber Lynn’s father and grandfather) do as a hobby and small business. The sun slightly peaked over the horizon, Ruby neighed quietly. I looked to the top of the hill, stretching widely, I remember times when we would be at Lake Allison at this time, touching the cold mud in the basin, walking down rock, following the water that trickles down them, and challenging trouts to races.
The grey screen door flew open on the porch, and Amber Lynn stepped out, wearing a pair of jeans, a v- neck olive green t- shirt, and a small gold necklace hooked to her neck. She was carrying a can of canned dog food, which she popped open and dumped into my ceramic bowl. I charged for the slices of meet greedily, swallowing loudly. I eat quicker than most dogs because my neck is bigger, The food slid down my throat and I licked the cowl clean, ready for a new meal. Amber Lynn laughed and slid her slender hand into the holes of the chain link and scratched behind my ear. As she pulled back, I noticed her fingernails were painted

Resolved Question: I need some advice about my 81 year old father inlaw!!!?
My father in law is a very hard person to deal with. He treats no-one with respect. He is not someone that I trust. He and my wife own a house together that they bought a couple of years ago. In the two and one half years he has lived there alone he has almost detroyed what is a very nice lake front property. Now he is wanting to sell it and wants us to buy a place together with him so we can be close by him to help take care of him. Although he gets around well. The new house deal will pay off all his debt and we will assume the mortgage. Nobody, not even his other children get along with him. He is very overbearing. I told my wife I don’t think this is a wise idea, but she thinks if we set boundaries he will abide by them. He hasn’t to this point and I don’t think he will in the future. My wife has a sizable investment and has some say so in the matter.Does anyone have any advice???

While there may be many opportunities for profit in those areas, the prices are supported largely by emotion and market sentiment and not hard data.

The price that the property is bought at must be significantly below the intrinsic value, otherwise the investment is no good. Remember that the intrinsic value is not a fixed value, but a general ball park. If one buys something in a ball park substantially below the intrinsic value ball park, then one is sure of getting a good deal.

Therefore, we have said that investors should not buy property unless it is eighty percent or below the intrinsic value. This will give us both a margin of safety and profit in the long term. We have discussed that the price will go up to match the intrinsic value over the long term; this is good if you plan on holding the property for a period of twenty or more years. More important, however, is the margin of safety concept. This difference between the intrinsic value and the price paid is the margin of safety, and it functions as a cushion to lessen the impact from, or completely protect against, any decline in price.

To assure ourselves a profit, we must not rely on appreciation, for this is us relying on chance. As nobody has a crystal ball, this is a silly strategy. Let us find another way.

By buying structurally homes which are in need of repair, we can assure ourselves a profit provided we follow this criteria: The price per square foot of newly constructed homes should have the price paid on the home subtracted from it.
